At NEPHE, we design high performance hockey sticks and we stand behind their build quality. These conditions describe the warranty that applies to products purchased from NEPHE SNC.
1. What the warranty covers
NEPHE warrants its sticks against manufacturing defects, meaning defects in materials or workmanship present from the outset, before any use.
By its nature, a manufacturing defect shows up during the very first uses. A stick used normally for more than a week without any anomaly has demonstrated the absence of an original defect. Beyond that point, a break results from the stresses inherent to hockey, not from manufacturing. NEPHE assesses every claim on this basis.
2. What the warranty does not cover
Hockey puts a stick under intense stress. The warranty does not cover breaks and damage resulting from it, in particular:
- slashes, hits, body checks, slap shots, and any unintended overload during play;
- contact with another player, a skate blade, the boards, the net, or the playing surface;
- normal wear, for example chips, scratches, or wear of the blade or the grip;
- use on concrete, asphalt, or any other abrasive surface, in particular in inline or street hockey;
- improper use, negligence, modification, alteration, or repair by a third party;
- products already replaced under a previous warranty claim, as well as promotional products, samples, or demo models.
3. Requirements to file a claim
For a claim to be admissible:
- the defect must be reported to NEPHE as soon as it is discovered;
- a valid proof of purchase must be provided;
- the serial number of the stick must be communicated;
- photos showing the defect, the break area, and the serial number must be sent.
NEPHE reserves the right to request the return of the product for inspection, and assesses on that occasion whether the break stems from a manufacturing defect or from use.
4. Handling of a valid claim
If the defect is recognised as a covered manufacturing defect, NEPHE will, at its option, repair or replace the product once.
Customs duties, VAT, and any import fees are set by the authorities of the destination country. They are outside NEPHE's control and remain payable by the customer. For an international shipment, the transport and logistics costs of delivering a replacement product may also be charged to the customer. Where possible, NEPHE offers to combine the shipment with another order in order to reduce these costs.
5. Exceptional gestures
NEPHE may, at its sole and free discretion, agree to replace a product or grant another commercial gesture in situations that are not covered by these conditions, for example in favour of a new customer or in particular circumstances. Such gestures are granted case by case, on a purely voluntary basis. They constitute neither an admission of liability, nor an entitlement, nor a precedent for any future claim.
6. Governing law
These conditions are governed by Swiss law. Mandatory consumer protection provisions remain reserved. The place of jurisdiction is the registered office of NEPHE SNC, subject to the mandatory places of jurisdiction provided by law.
